1. About Unwavering

Unwavering is a daily discipline application for iPhone and iPad that delivers curated quotes from history's most disciplined minds — stoic philosophers, military leaders, elite athletes, and visionary entrepreneurs. These Terms govern your use of the Unwavering app and any related services or websites operated by us.

"Unwavering," "we," "us," or "our" refers to Vibe2Viable, the developer and operator of the Unwavering application. "You" refers to the individual using the app.

2. Acceptance of Terms

By downloading, installing, or using Unwavering, you confirm that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy.

If you are under 18, you may use Unwavering only with the consent of a parent or guardian who agrees to these Terms on your behalf.

3. Subscriptions and Payment

3.1 Subscription Plans and One-Time Purchases

Unwavering offers a free tier and optional paid plans that unlock the full app experience, including the complete quote library, all premium collections, advanced widget support, and early access to new content. Current pricing:

• Monthly Subscription: $3.99/month
• Annual Subscription: $34.99/year
• Lifetime Access: $74.99 (one-time purchase, no recurring charges)

Pricing may change. See Section 3.5 for details. Lifetime Access is governed by the specific terms in Section 3.6.

3.2 Payment Processing

All purchases and subscription payments are processed entirely through the Apple App Store via StoreKit. We do not collect, handle, or store your payment information in any form. Your purchase is subject to Apple's terms and conditions: apple.com/legal/internet-services/itunes/.

3.3 Auto-Renewal

Monthly and annual subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the renewal date. You will be charged through your Apple ID account. Lifetime Access is a one-time purchase and does not auto-renew (see Section 3.6).

To cancel your subscription: open iOS Settings → tap your name → Subscriptions → select Unwavering → Cancel Subscription.

Important: Deleting the Unwavering app from your device does not automatically cancel your subscription. You must cancel through iOS Settings as described above to stop future charges.

3.4 Refunds

All refund requests are handled by Apple in accordance with their App Store refund policy. To request a refund, visit reportaproblem.apple.com. We do not have the ability to issue refunds directly.

3.5 Price Changes

We may change subscription prices from time to time. Apple will notify you before any price change takes effect. If you do not agree with the new price, you may cancel before the next renewal.

3.6 Lifetime Access

Definition. The "Lifetime Access" purchase is a one-time, non-refundable in-app purchase that grants you permanent access to all current premium features and content available in Unwavering for the duration that the app remains commercially available. "Lifetime" refers to the operational lifetime of the app, not the biological lifetime of any individual user.

Scope. Lifetime Access grants the same premium features available to active subscribers: all content collections, guided programs, passage collections, unlimited notification schedules, and widgets, as these features exist at the time of purchase. Lifetime Access does not guarantee the delivery of future features, content expansions, or software updates beyond those included at purchase.

Restoration. Lifetime Access is tied to your Apple ID. You may restore your purchase at no charge on any device signed in to the same Apple ID by using the "Restore Purchases" function in the app.

Transferability. Lifetime Access is non-transferable and may not be sold or assigned to another user or account. However, as a non-consumable in-app purchase, Lifetime Access may be shared with members of your family group through Apple Family Sharing in accordance with Apple's rules for Family Sharing, where supported.

Sunset Policy. If we discontinue Unwavering or remove it from the App Store, we will make reasonable efforts to provide at least 30 days' advance notice via the app itself or the support contact listed on the App Store listing. Users who purchased Lifetime Access within 90 days of a discontinuation announcement may contact us at support@vibe2viable.com to request a refund of their purchase price.

Limitation for Platform Changes. We are not responsible for loss of access caused by changes to the iOS platform, App Store policies, or other factors outside our reasonable control. We make no warranty that the app will remain available indefinitely.

4. Use of the App

4.1 License

We grant you a limited, non-exclusive, non-transferable, revocable license to use Unwavering on Apple devices you own or control, for personal, non-commercial purposes, in accordance with these Terms.

4.2 Prohibited Uses

You agree not to:

• Copy, modify, distribute, sell, or sublicense any part of the app or its content
• Reverse engineer, decompile, or disassemble the app
• Use the app for any unlawful or unauthorized purpose
• Remove or alter any copyright, trademark, or proprietary notices
• Attempt to circumvent subscription requirements or access restrictions
• Use automated means to access or interact with the app

4.3 Eligibility

Unwavering is available on the App Store for users in supported regions. You must comply with all applicable laws in your jurisdiction when using the app.

5. Content

5.1 App Content

All quotes, collections, interface elements, and other original content within Unwavering are owned by us and protected by copyright and intellectual property laws. You may not reproduce or redistribute this content without our permission.

5.2 Quote Attribution

Unwavering strives to provide accurate attributions for every quote in the library. However, historical attribution can be complex. While we make best-effort attempts to verify sources and attributions against primary texts and reputable historical records, we cannot guarantee the absolute accuracy of every attribution. We do not warrant that all quotes are verbatim or perfectly attributed.

If you believe a quote is misattributed, please contact us at support@vibe2viable.com so we can investigate and correct it.

5.3 Personal Use Only

The content in Unwavering is licensed to you for personal, non-commercial use only. Purchased subscriptions are for individual use and may not be shared, except as permitted through Apple Family Sharing or equivalent platform-provided family sharing features.

5.4 Not Professional Advice

The quotes and content in Unwavering are provided for personal enrichment, motivation, and discipline purposes only. They are not a substitute for professional medical, psychological, mental health, financial, or legal advice.

6. Data and Privacy

Unwavering stores your preferences, notification settings, streak data, and favorites locally on your device. We do not collect personal data on our servers.

7. Disclaimer of Warranties

UNWAVERING IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The app will be uninterrupted, error-free, or free from bugs
• The content will produce any particular result for your discipline or performance
• The app will be compatible with all devices or operating system versions
• Any defects will be corrected
• All quote attributions are perfectly accurate

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL VIBE2VIABLE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of data or app content (e.g., streak loss after device reset)
• Loss of access during service interruptions or app updates
• Any outcomes related to your use of content in the app
• Damages arising from reliance on quotes or attributions in the app

Vibe2Viable's total liability to you for any claim arising out of these Terms or your use of Unwavering shall not exceed the amount you paid for your subscription in the twelve (12) months preceding the claim, or $10, whichever is greater.

9. Indemnification

You agree to indemnify and hold harmless Unwavering and its developers from any claims, losses, liabilities, damages, costs, or expenses (including reasonable attorneys' fees) arising from your violation of these Terms or your misuse of the app.

10. Third-Party Services

Unwavering may link to or reference third-party websites or services (such as Apple's App Store). We are not responsible for the content, privacy practices, or terms of any third-party services.

Your use of the App Store is governed by Apple's terms and conditions. Apple is not a party to these Terms and has no obligation to provide support or maintenance for Unwavering.

11. Termination

We reserve the right to discontinue Unwavering or remove it from the App Store at any time, with or without notice. If the app is discontinued, your subscription (if active) will be managed through Apple's standard refund policies.

You may stop using Unwavering at any time by deleting it from your device and cancelling any active subscription through the App Store.

12. Force Majeure

We shall not be liable for any delay or failure to perform resulting from causes outside our reasonable control, including, without limitation, acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, epidemics, strikes, shortages of transportation, fuel, energy, labor, or materials, failure of third-party services (including Apple's App Store or cloud infrastructure providers), or interruptions to the internet or telecommunications infrastructure.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be noted in App Store release notes and on this page. The "Last Updated" date at the top of this page reflects when the Terms were most recently revised.

Your continued use of Unwavering after changes are posted constitutes your acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of the Commonwealth of Virginia, United States, without regard to conflict of law principles. Any disputes arising from these Terms or your use of Unwavering shall be resolved in the state or federal courts located in Virginia.

ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. YOU AND VIBE2VIABLE AGREE TO WAIVE ANY RIGHT TO A JURY TRIAL OR TO PARTICIPATE IN A CLASS ACTION.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will remain in full force and effect.

16. Platform-Specific Terms

The following platform-specific terms apply based on where you obtained Unwavering. They supplement the preceding sections of these Terms. In the event of any conflict between a platform-specific term in this section and a preceding section, the platform-specific term controls for users who acquired Unwavering through that platform.

16.1 Apple App Store (iOS, iPadOS, macOS)

If you obtained Unwavering through the Apple App Store, the following terms apply between you and Vibe2Viable LLC, and not between you and Apple Inc. ("Apple").

16.1.1 Acknowledgment

These Terms are concluded between you and Vibe2Viable LLC only, and not with Apple. Apple is not responsible for Unwavering or its content. To the extent these Terms provide for usage rules for Unwavering that are less restrictive than, or conflict with, the Apple Media Services Terms and Conditions, the more restrictive or conflicting Apple term applies.

16.1.2 Scope of License

The license granted to you for Unwavering in Section 4.1 is further limited to a non-transferable license to use Unwavering on any Apple-branded products that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions. The license also permits you to access Unwavering through Apple Family Sharing, subject to Apple's rules for Family Sharing. Where these Terms refer to "individual use" or otherwise restrict sharing of subscriptions or purchases, such restrictions do not prevent sharing permitted through Apple Family Sharing.

16.1.3 Maintenance and Support

Vibe2Viable LLC is solely responsible for providing any maintenance and support services with respect to Unwavering, as specified in these Terms or as required under applicable law. Apple has no obligation whatsoever to furnish any maintenance or support services with respect to Unwavering.

16.1.4 Warranty

Vibe2Viable LLC is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed in these Terms. In the event of any failure of Unwavering to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) you paid for Unwavering through the App Store. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to Unwavering, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be Vibe2Viable LLC's sole responsibility.

16.1.5 Product Claims

Vibe2Viable LLC, not Apple, is responsible for addressing any claims you or any third party may have relating to Unwavering or your possession and use of it, including but not limited to: (i) product liability claims; (ii) any claim that Unwavering fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.

16.1.6 Intellectual Property Rights

In the event of any third-party claim that Unwavering or your possession and use of Unwavering infringes that third party's intellectual property rights, Vibe2Viable LLC, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

16.1.7 Legal Compliance

You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

16.1.8 Third-Party Beneficiary

You and Vibe2Viable LLC acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms as they apply to your license to Unwavering, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.
